Wendy's CEO: Our wounds were 'self-inflicted' (AP)

NEW YORK ? Wendy's new CEO on Monday called the dour results of the past few years "self-inflicted wounds" and vowed to do better, laying out plans that included hiring top-tier workers and reclaiming market share from higher-end competitors like Five Guys and Smashburger.

Emil Brolick, the CEO since September, told investors on Monday that he was intent on winning back customers, jaded by a stale menu and inconsistent service, as well as investors, who have grown weary of "a little bit of overpromising and under-delivering."

And rather than blaming the struggling economy for the revenue declines and quarterly losses of the past few years, Brolick said that the company's problems were its own fault. Though Wendy's Co. had carved out a niche in the restaurant business as fast food for grownups, it had lost its way in recent years.

"These are not DNA issues," said Brolick, who also worked at Wendy's during more halcyon days of the late '80s and early '90s. "These are issues we caused, and any time you have self-inflicted wounds, you can correct self-inflicted wounds."

Brolick said he was intent on taking back lost market share from the likes of fast-casual competitors like Panera and Chipotle, by offering food that was just as good but at a lower price. The company has revamped its menu and is remodeling stores. It sold Arby's, which had been a drag on earnings, over the summer. And it's now intent on hiring "five star" employees in line with those at the fast-casual chains, Brolick said.

"Those folks at the bottom corner, there's a job waiting for them at our competitors," said Brolick, who has also hired a new general counsel at the Ohio headquarters and is adding a chief marketing officer and chief people officer.

Brolick, who was most recently a top executive at Yum Brands Inc., said he's bringing all Wendy's locations up to consistent standards for friendliness and cleanliness, rather than the current, unpredictable state of "one there is really, really good but this one over here isn't quite what it needs to be."

"We've made great progress in getting rid of those F restaurants and getting more A's and B's, but we're still in that territory," Brolick said.

Like many fast-food chains, Wendy's is taking some of its turnaround plans from McDonald's book. The much-larger burger chain has done well throughout the recession and its aftermath by trying to reinvent itself as a hip, healthy place. New offerings like fancy coffee drinks and smoothies, and remodeled restaurants with wireless access, have brought in customers who previously might have shunned it. At the same time, McDonald's has kept prices at fast-food levels so that its reliable base of cash-strapped customers doesn't flee for cheaper hamburgers at the gas stations.

McDonald's has run into some resistance from franchisees who sometimes have to foot the bill for the changes. Brolick said Wendy's franchisees were "very, very supportive "of the plans. He acknowledged that "we are going to spend a lot of their money," then added later: "The economics have to work. They do work."

Brolick's message to investors, who gathered at the Nasdaq building in New York, came a few hours after the company reported mixed results for the fourth quarter.

Wendy's income from continuing operations fell 30 percent to $4.3 million in the last three months of the year, down from $6.1 million in the fourth quarter of 2010. That year-ago number strips out the effect of Arby's, which Wendy's sold this summer to a private-equity firm.

Wendy's marriage with Arby's was short-lived. It began in the depths of the financial crisis in fall 2008, and ended when managers said they wanted to focus on the Wendy's brand alone. Wendy's said Monday it spent nearly $46 million over 2011 to break up with Arby's, including severance costs for some employees and retention bonuses for others.

Revenue rose 5.6 percent to $615 million, narrowly beating the $613 million predicted by analysts. The chain credited more customers visiting and spending more when they did, including on the revamped Dave's Hot 'N Juicy cheeseburger. Higher prices also helped.

Revenue at restaurants open at least a year climbed 4.4 percent in North America, the highest number in nearly 8 years, according to the company. That's a key measure of a company's health because it strips out the effect of newly opened or closed stores.

On a per-share basis, adjusted earnings were 4 cents, in line with the expectations of analysts polled by FactSet. That number excluded one-time charges like the costs for selling Arby's and writing down the value of some of its assets. With those charges, per-share earnings would have been 1 cent per share.

Last week, Barclays Capital analyst Jeffrey Bernstein spoke favorably of the changes at Wendy's, saying the company has greater potential for long-term earnings growth than competitors but is trading at a comparative discount. Sanford C. Bernstein analyst Sara Senatore said Monday that though revenue numbers beat her expectations, some of the earnings predictions that the company made for 2012 were below Wall Street's expectations.

Wendy's shares fell 20 cents, or 3.8 percent, to close at $5.01.

After solar flare, massive storm speeds Earthward

A solar flare Sunday triggered an outburst of solar material that should hit Earth Tuesday. The disturbance could lead to voltage swings on some power lines, as well as stronger northern lights.

The radiation storm is the first act of an event that will crescendo Tuesday, when the brunt of the outburst ? called a coronal-mass ejection ? arrives at Earth. The current radiation storm?? rated an S3, or strong, on a scale of 1 to 5 ? could damage satellite hardware and present an increased risk of radiation exposure to passengers flying at high altitudes across polar routes, say space-weather specialists. These risks, however, are expected to be manageable. ?

The outburst, which occurred at 11 p.m. Eastern Standard Time Sunday, marks the second major solar eruption in three days.

Sunday's event began with a moderate solar flare that was "nothing special" on its own, says Doug Biesecker, a solar physicist at the National Oceanic and Atmospheric Administration's Space Weather Prediction Center in Boulder, Colo.

But the flare triggered the release of billions of tons of energetic particles from the sun's atmosphere.?This coronal-mass ejection (CME) is hurtling toward Earth at 4 million miles an hour, "by far the fastest CME directed at the Earth during the current solar cycle," Dr. Biesecker says.?

CMEs are vast clouds of protons, electrons, as well as heavy atomic nuclei formed in the nuclear fusion reactions that power the sun.

This CME's unusually high speed is accelerating some of its protons to nearly the speed of light, and they are arriving in quantities not seen since May 2005.

The resulting radiation storm could cause some hardware or onboard software glitches for satellite operators. And radio communications at high latitudes, as well as navigation-satellite accuracy for high-precision uses, could suffer some degradation for the duration of the radiation storm.?

A geomagnetic storm Tuesday could further affect satellites.

For satellite operators, geomagnetic storms have a Janus-like quality. If strong enough, they can produce voltages on a satellite's exterior that can be powerful enough to arc and cause damage. And the storms can increase the atmosphere's drag on satellites, causing them to lose altitude.

But such storms also can increase drag on space junk that can pose a risk to satellites, sending more of it to burn up in Earth's atmosphere.

This week's geomagnetic storm also could bring auroras to viewers farther south than usual.

Biesecker says the storm may reach a level that could render auroras visible as far south as Idaho and New York, and perhaps even Illinois and Oregon if the CME's intensity is large than estimated.

Altitude sickness causes Tracy Morgan Sundance collapse (Reuters)

(Reuters) ? "30 Rock" actor Tracy Morgan collapsed at the Sundance film festival over the weekend and is being treated for exhaustion and altitude sickness, his publicist said on Monday.

Spokesman Lewis Kay said initial reports that Morgan was drunk were untrue.

"From a combination of exhaustion and altitude, Tracy is seeking medical attention. He is with his fiance and grateful to the Park City Medical Center for their care. Any reports of Tracy consuming alcohol are 100% false," Kay said in a statement.

Morgan, 43, was taken to the hospital in Park City, Utah, on Sunday while attending a charity event during the annual Sundance film festival in the ski resort.

The actor's new comedy "Predisposed" is one of the dozens of films at the festival, which champions independent movies.

(AP) ? Fresh off a resounding victory, Newt Gingrich faces a formidable financial challenge as he storms into Florida ? raising money.

The former House speaker ? whose campaign still is carrying debt ? has little choice but to move rapidly to convert momentum from his South Carolina triumph into dollars to spend in Florida, a much larger and more diverse state with multiple media markets that bear a hefty $2 million price tag to blanket the state with TV ads over the next week.

He's already working to tap into Rick Perry's deep base of donors, following the Texas governor's departure from the race and endorsement, as well as the vast grassroots network of his now defunct political group, American Solutions. And, even if aides won't publicly acknowledge it, Gingrich probably also is betting on his wealthy friends continuing to open their wallets to a political action committee working to help elect the former Georgia congressman.

Casino magnate Sheldon Adelson essentially saved Gingrich's campaign as the race turned to South Carolina almost two weeks ago by pouring $5 million into the Winning Our Future super PAC that aired ads tearing into chief rival Mitt Romney, helping pave the way for a Gingrich victory. With Gingrich now winning, it's tough to see how Adelson returns to the sidelines now.

Even before his South Carolina victory, a confident Gingrich said in Orangeburg, S.C.: "We will have what we need to compete."

But the urgency was clear in the minutes after The Associated Press declared him the winner Saturday night.

He quickly sent a tweet thanking supporters and appealing for a flood of donations for the Jan. 31 primary. "Help me deliver the knockout punch in Florida. Join our Moneybomb and donate now," said his tweet. And later, he pleaded in an email: "If you want to see a Reagan conservative as the nominee, and if you want to watch us run circles around Barack Obama in the debates with bold, conservative ideas, then please make a donation today."

Gingrich's campaign did not immediately respond to questions about whether the financial floodgates have opened in the wake of his victory.

Aides have said he raised roughly $9 million in the final quarter of last year. But the campaign still is carrying about a half a million dollars in debt from spring and summer when his campaign was struggling.

In that same time period Romney says he has raised $24 million. And he and his allies have been on the air in Florida ? alone ? for weeks, blanketing the state with his campaign pitch and targeting the thousands of Florida Republicans who have been casting absentee ballots since last month.

Given all that and with only nine days before the primary, there's no time for Gingrich to waste.

He was spending Sunday in Washington, attending a church service and working to raise money behind the scenes, including reaching out to former Perry donors who helped the Texas governor raise $17 million during the third quarter of 2011.

A giant plea for money also greeted visitors to Gingrich's website Sunday in hopes that fans of his books and time on the speaking circuit would donate.

Gingrich will have help.

Super PACs, like the pro-Gingrich Winning Our Future that's independent of his campaign, are certain to play aggressively in Florida, perhaps to a greater level than they did in Iowa, New Hampshire and South Carolina.

The independent groups can spend unlimited amounts of money in elections since federal court rulings in 2010 stripped away previous restrictions. The super PACs can't coordinate with campaigns, but many ? including Gingrich's and Romney's ? are staffed by people with ties to the candidates.

Already the pro-Romney super PAC ? Restore Our Future ? has spent a jaw-dropping $4 million in advertising in Florida, with Romney himself doling out nearly $2.5 million. Gingrich and his allies have yet to run an ad in the state.

At a deficit already, Winning Our Future and others supporting Gingrich expect that the spigot of money will continue flowing.

Still, they will be competing for dollars with super PACs supporting other candidates, particularly the Red, White and Blue Fund that's supporting former Pennsylvania Sen. Rick Santorum.

"Even if he gets 1 percent in South Carolina, I'm still for Rick," said Foster Friess, a Wyoming businessman who's been a major backer to the Santorum-leaning super PAC.

Gingrich's reliance on outside support is a reversal. He decried the influence of the independent groups in Iowa as they battered him in the state, and pledged to run a positive campaign. Then he kept losing. And a super PAC rushed to his defense.

The candidate himself has struggled to raise money this year despite being known for his fundraising prowess that dates to the 1990s when he engineered the Republican takeover of the House. After he left Congress, he turned his conservative political group, American Solutions for Winning the Future into a fundraising powerhouse, using the cash to continue a busy travel schedule that kept his name in the news. Gingrich owns the groups donor list.

When his campaign imploded last year, Gingrich relied on using that grass-roots network and social media to raise money.

"He's done well with less money than Romney," said John Grant, a Baptist leader and one of Gingrich's Florida evangelical chairmen. "It's because he's the atypical candidate."

Cell senescence does not stop tumor growth

Since cancer cells grow indefinitely, it is commonly believed that senescence could act as a barrier against tumor growth and potentially be used as a way to treat cancer. A collaboration between a cancer biologist from the University of Milano, Italy, and two physicists, from the National Research Council of Italy and from Cornell University, has shown that cell senescence occurs spontaneously in melanoma cells, but does not stop their growth, which is sustained by a small population of cancer stem cells. The results, published in the open-access journal PLoS Computational Biology on January 19 explain why it is difficult to treat cancer cells by inducing senescence alone.

The work explores the relationship between melanoma and senescence, the normal process where cells decline and eventually stop duplicating after reaching maturity. The investigators followed the long-term evolution of melanoma cell populations, monitoring the number of senescent cells. After three months, growth slowed and most of the cells turned senescent, however growth did not stop and eventually resumed its initial rate until the senescent cells had almost disappeared.

The authors mathematically modeled the experimental data using the cancer stem cell hypothesis, where a sub-group of cancer cells replicate indefinitely, and are thus unaffected by senescence. These cancer stem cells give rise to a larger population of cancer cells that can duplicate only a finite number of times. The model yielded an indirect confirmation of the presence of cancer stem cells in melanoma, an issue that is still controversial in the cancer research community.

Although a large fraction of cancer cells are susceptible to senescence, the researchers conclude that inducing senescence is unlikely to provide a successful therapeutic strategy because these cells are irrelevant for tumor growth. However, the indirect evidence of cancer stem cells in melanoma may enable the development of new methods to treat specific kinds of cancer. The challenge will be in the strong resistance to drug induced senescence that would be found in the cancer stem cells. Along this line of research, treatment of tumors would focus on targeting only these cancer stem cells, rather than every single cancerous cell.

Top Iraqi Shiite cleric urges end to crisis (AP)

BAGHDAD ? Iraqi authorities detained a senior Sunni official on terrorism charges Friday, even as an aide to the country's most prominent Shiite cleric urged politicians on both sides of the sectarian divide to end an escalating political crisis.

The political battle erupted last month after the Shiite-led government issued an arrest warrant against the Sunni vice president, Tareq al-Hashemi, on terrorism charges, sending him into virtual exile to the Kurdish autonomous region in northern Iraq. In protest, al-Hashemi's Sunni-backed Iraqiya bloc has been boycotting parliament and Cabinet sessions, bringing government work to a standstill.

On Friday, security forces took Ghdban al-Khazraji, the deputy governor of Diyala province, into custody, said Iraqiya lawmaker Hamid al-Mutlaq. A police official in the predominantly Sunni province north of Baghdad said al-Khazraji was detained on terrorism charges. The official spoke on condition of anonymity because he was not authorized to brief the media.

Al-Mutlaq said al-Khazraji's arrest is an escalation of what he said is a campaign by Prime Minister Nouri al-Maliki, a Shiite, against the Sunni minority and part of al-Maliki's efforts to cement his grip on power.

"It will add more complications to the political process," al-Mutlaq said.

Another Iraqiya lawmaker, Raad al-Dahlaki, told The Associated Press that security forces also raided the house of Diyala's second deputy governor, Talal al-Jubouri. He was not at home when Iraqi anti-terrorism troops stormed his house Friday, al-Dahlaki said.

The political troubles coincide with a wave of bombing attacks, most of them targeting Shiites, killing more than 160 people this year. The twin crises have raised fears of a reprise of a conflict five years ago, when heavily armed Shiite and Sunni militias battled each other and brought the nation to the brink of civil war.

The growing tensions prompted Grand Ayatollah Ali al-Sistani, who is revered by Iraqi's Shiite majority, to urge both sides to find a solution to the crisis.

Al-Sistani's aide, Ahmed al-Safi, said during a Friday sermon in the holy city of Karbala that after years of conflict, Iraq "cannot bear further tensions among politicians."

Al-Sistani normally exerts his influence through sermons and statements made by his aides.

On Wednesday, Iraqiya's leader Ayad Allawi accused al-Maliki of unfairly targeting Sunni officials and deliberately triggering a political crisis that is tearing Iraq apart. Allawi, who is a Shiite, said Iraq needs a new prime minister or new elections to the country from disintegrating along sectarian lines.

ISLAMABAD ? A scandal over a secret memo to Washington that could bring down the Pakistani president took a strange turn Wednesday when a music video surfaced featuring the chief accuser acting as a commentator for a naked female wrestling bout.

Opponents of Mansoor Ijaz, an American of Pakistani origin, said the clip damaged his credibility ahead of his scheduled appearance at a Supreme Court commission in this conservative Muslim country. The Florida-born businessman has pledged to provide damning evidence that the Pakistani government sent the note seeking U.S. help preventing a military coup in the aftermath of the American raid that killed Osama bin Laden on May 2, 2011.

Others were simply amused at the latest twist in an affair that has transfixed the media and raised tensions between the government and the powerful military to dangerous levels. Dubbed "memogate" in the Pakistani media, one Twitter user suggested it should now be renamed "booty-gate."

Ijaz, who boasts of close friendships with the U.S. security establishment and past back-channel diplomatic roles in Sudan and Kashmir, claims the unsigned memo was authored by the then-Pakistan envoy to Washington, Husain Haqqani.

Ijaz says that at Haqqani's request, he delivered the memo to Adm. Mike Mullen, the top U.S. military officer at the time. Mullen's spokesman confirmed that his boss did receive the memo from Ijaz but that he did not find it credible and ignored it.

Haqqani denied any role in the memo but resigned last year amid pressure from the outraged military. Ijaz has said that he gave computer records implicating Haqqani to Pakistan's spy chief, Lt. Gen. Shuja Pasha, who he says flew to London to meet with him in October. Pasha has told the court that he found the evidence credible.

The country's top court is now probing the affair, which some believe could result in treason charges against Haqqani. President Asif Ali Zardari could also be vulnerable if ? as Ijaz's lawyer claims ? it can be proven he also knew about the note. The investigation comes as Pakistani-U.S. relations are at an all-time low.

It was unclear why the wrestling video, which was made in 2004 and has been viewed for years on the Internet, came to light only now. Ijaz's role was apparently spotted by a blogger late Tuesday and spread quickly through social media.

Ijaz told The Associated Press he thought the video's emergence was part of an effort by Haqqani to discredit him ahead of his testimony but conceded he had no evidence of this. He confirmed that the video was not a hoax.

Ijaz appears in two versions of the same video for "Stupidisco," a house music track by Italian producer Junior Jack that was a club hit in 2004.

One clip features bikini-clad women wrestlers 'Double D' and 'Nasty Nancy,' who end up grappling on a mat in a sexually provocative fashion. The other is the same until the final 30 seconds, when the women remove each other's clothes.

Ijaz's scenes and dialogue feature in both versions.

"She's giving it to her good now! You've got some real tumbling going on here. Nancy's got that mean look," he says, as the two women wrestle in front of him. At one point, Ijaz's eyes widen and his mouth gapes as the video cuts to the women ripping each other's bikinis off.

Ijaz said he had not known he would appear in the version containing full nudity.

"I did this as a favor for my wife's best friend, whose planned actor for the part did not show up for the shoot that day," he said in a telephone interview from an undisclosed location, citing alleged threats to his life as a result of his role in the memo scandal. He said the shoot took place in Brussels, and that there was no other person available with an American accent.

"I was never present for any part of the video where those naked girls were shown. My wife was present at all times."

Ijaz provided the AP with 2004 email correspondence between him and the producer of the video in which he threatens legal action unless the producer removes him from the clip that contains nudity.

"Given my political and public profile in the United States and around the world, it is impossible for me to appear in any part of any video clip with nudity of any type," he wrote. He included a reply from the producer, who assured Ijaz he would cut his role from the X-rated version and remove it from the Internet.

Haqqani's lawyer, Zahid Bokhari, said the "Stupidisco" video shows that Ijaz "can break all the norms of decency."

"I think a man of that stature, one who can go to that extent for fame, he can make up all kinds of false stories. I am really stunned by this," said Bokhari. He dismissed Ijaz's claim that the video was part of campaign to question his credibility, noting that it was made and put on the Internet years ago.

The bikini video was uploaded onto YouTube in 2009, with 376,000 views since then, according to that website. The version in which the women appear naked was uploaded to a site called Dailymotion in 2007.

For Ijaz, the videos cast an unwelcome spotlight on his plans to come to Pakistan and testify to the Supreme Court commission next Tuesday. Ijaz has said he will present Blackberry smart phones with records of conversations between him and Haqqani that prove the former envoy authored the memo.

Interior Minister Rehman Malik, a Zardari loyalist, has hinted Ijaz could face legal troubles himself if he comes to Pakistan, alleging he once claimed to have brought down an earlier government.

Local media have speculated that Ijaz will fly into a military air base and then be escorted by the army to the court to testify, such is his importance to the case.

Akram Sheikh, Ijaz's lawyer, claimed the government was trying to stop his client from traveling to Pakistan.

"So what if my client has been dancing on the Internet," said Sheikh. "What difference does that make? He has never claimed to be perfect, or running an orphanage. Would Mr. Haqqani like his personal life exposed?"

Haqqani, who returned to Pakistan to cooperate with the probe, is now living as a guest at the prime minister's residence, claiming his life is in danger. He has been banned by the commission from leaving the country. His wife has lobbied in Washington in his defense, and several U.S. lawmakers have spoken up for him.

The memo scandal is not the only threat to the Pakistani government, which has struggled since Zardari's election in 2008. Like previous governments, his administration has had difficult relations with the army, which has never trusted Zardari.

On Thursday, Prime Minister Yousuf Raza Gilani is to appear before the Supreme Court to explain why his government has not asked Swiss authorities to reopen an old corruption case against Zardari. The court has initiated contempt proceedings against Gilani for failing to do this.

The government has long refused to write the letter, arguing that Zardari enjoys immunity from prosecution while in office. But Gilani's lawyer, Aitzaz Ahsan, said Wednesday that "there was no harm" in writing the Swiss because Zardari enjoys immunity from prosecution.

SOPA Blackout: Help Stop Internet Censorship!


A key bill currently before the U.S. Congress, the Stop Online Piracy Act (SOPA), and its companion bill in the Senate, the Protect IP Act (PIPA), need to be torpedoed ASAP.

At THG, we normally refrain from such overt political messages, but the fact is these bills would censor content and impose harmful regulations on millions of people.

Legions of Internet users and entrepreneurs oppose SOPA and PIPA, and for good reason. They would enable the government to - indiscriminately - regulate the web.

If these bills pass, which is a real threat, the web will be transformed dramatically. Not only are the livelihoods of sites like THG at risk, but behemoths like Google.

In a nutshell, the bill would enable easy, and unnecessary blocking of entire sites. Small ones won't have sufficient resources to defend themselves against corporate giants.

Big media companies may seek to cut off funding for competitors, even if copyright isn't infringed. Millions will be suppressed, strong-armed and blacklisted - LEGALLY.

Combating piracy of intellectual property is a worthwhile goal, but there are fair, effective means of achieving it without broad government overreach into our lives.

SOPA and PIPA are not it. In fact, they will do just the opposite, quashing the innovation of small businesses everywhere while rewarding a select few arbitrarily.

The only PIPA we like is Pippa Middleton. The only SOPA we care about is ... we have no joke for that one. It hits so close to home, we can't even think straight.

Contact your U.S. representative. Tell others to do the same. Follow this link to join Google's effort against censorship and stand up for individual liberty.

Otherwise, the Internet as you know it may be altered forever.

Peace Corps pullout a new blow to Honduras

TEGUCIGALPA, Honduras (AP) ? The U.S. government's decision to pull out all its Peace Corps volunteers from Honduras for safety reasons is yet another blow to a nation still battered by a coup and recently labeled the world's most deadly country.

Neither U.S. nor Honduran officials have said what specifically prompted them to withdraw the 158 Peace Corps volunteers, which the U.S. State Department said was one of the largest missions in the world last year.

It is the first time Peace Corps missions have been withdrawn from Central America since civil wars swept the region in the 1970s and 1980s. The Corps closed operations in Nicaragua from 1979 to 1991 and in El Salvador from 1980 to 1993 for safety and security reasons, but has since returned to both countries.

But the wave of violence and drug cartel-related crime hitting the Central American country had affected volunteers working on HIV prevention, water sanitation and youth projects, President Porfirio Lobo acknowledged.

Monday's pullout also comes less than two months after U.S. Rep. Howard Berman, a California Democrat, asked Secretary of State Hillary Clinton to reconsider sending police and military aid to Honduras as a response to human rights abuses.

"It's a welcome step toward the United States recognizing that they have a disastrous situation in Honduras," said Dana Frank, a University of California Santa Cruz history professor who has researched and traveled in Honduras.

The decision to pull out the entire delegation came after a Peace Corps volunteer was robbed and raped near the village of Duyure in southern Honduras on Jan. 24, 2011. Three men were found guilty of rape and robbery in that case, according to an employee of the regional court in the southern city of Choluteca who was not authorized to be quoted by name. Sentencing is scheduled for February; the three men face up to 26 years in prison. The volunteer was apparently assaulted while hiking in a remote area.

On Dec. 3, a female Peace Corps volunteer was shot in the leg during an armed robbery aboard a bus in the violence-torn city of San Pedro Sula.

Hugo Velasquez, a spokesman for the country's National Police, said 27-year-old Lauren Robert was wounded along with two other people. One of the three alleged robbers was killed by a bus passenger, Velasquez said. The daily La Prensa said Robert is from Texas.

Most areas of San Pedro Sula, like other especially violent parts of Honduras, had been declared "banned or highly discouraged for volunteers," according to the June 2011 edition of the Corps' "Welcome Book." Also banned were "all beaches at night" and a large part of the country's Atlantic coast.

The U.S. also announced it was suspended training for new volunteers in El Salvador and Guatemala, though they kept open the possibility of sending new teams of volunteers once a review of security conditions is finished. El Salvador has 113 volunteers, and there are 215 in Guatemala, where the head of the Peace Corps pledged the program would continue.

The three countries make up the so-called northern triangle of Central America, a region plagued by drug trafficking and gang violence. El Salvador has the second highest homicide rate with 66 killings per 100,000 inhabitants, the U.N. has said.

Numerous non-governmental aid groups work in the region and the Peace Corps decision has raised concerns that they could also be affected.

"This is not a good moment for Honduran NGOs," said Oscar Anibal Puerto, director of the Honduran Institute for Rural Development, which works on school construction and water projects, often with Spanish financing and sometimes in informal cooperation with Peace Corps volunteers.

He said financing from Spain has begun to dry up because of that country's debt crisis, and while the Peace Corps withdrawal "has not significantly affected us," he said he worried it could set an example for other donor countries to pull out.

But Puerto said he could understand the U.S. decision.

"Their concerns are justified, until the security situation in Honduras improves," he said. "Human values have been lost. Crime is the order of the day."

Honduras joins Kazakhstan and Niger as countries that have recently had their volunteers pulled out. The Kazakhstan decision followed reports of sexual assaults against volunteers. The Niger decision came after the kidnapping and murder of two French citizens claimed by an al-Qaida affiliate.

A U.N. report, released in October 2011, said Honduras had the highest homicide rate in the world with 6,200 killings, or 82.1 murders per 100,000 inhabitants in 2010.

"Violence affects all Hondurans. It wouldn't be surprising if Peace Corps members, too," said Jose Rolando Bu, president of a group that represents non-governmental agencies.

Between June 2010 and June 2011, nine U.S. citizens were killed in Honduras, most in San Pedro Sula or northern coastal areas.

The Peace Corps had sent volunteers to Honduras since 1962, and around 1982 it was the largest mission in the world, according to the U.S. State Department. The U.S. sent more people to help after Hurricane Mitch in 1998.

The volunteers in Honduras had been working on projects focused on HIV/AIDS prevention, water sanitation and youth development. It was not clear what effect their departure would have on those efforts; no other aid agency immediately announced any pullout based on security concerns.

Peace Corps volunteer Claire Krebs, an engineer from Houston, Texas, described her work in the mid-sized city of Choluteca on the Peace Corps Journals blog site. Krebs wrote that she surveyed, planned and designed water systems for rural Honduran villages, which involved visits to rural areas in the country's somewhat more tranquil southern region, where there were few apparent security problems.

Krebs was training Hondurans to do the work she was doing, but it was unclear if they could yet replace her.

Berman said in the Nov. 28, 2011, letter to Clinton that he worried that some murders in Honduras appeared to be politically motivated because high-profile victims included people related to or investigating abuses by police and security forces, or to the June 28, 2009, ouster of President Manuel Zelaya. The coup lead to the temporary diplomatic isolation of Honduras.

On Tuesday, a Honduran lawyer who had reported torture and human rights violations by police officers was killed by gunmen, authorities said.

Three men stormed into the office of Ricardo Rosales, 42, shot him dead and escaped, said Hector Turcios, the police chief of Tela, a city 150 miles (240 kilometers) north of the capital.

Rosales had told local press that officers had tortured jail inmates in his city.

Stop pirating my stories about SOPA, or I'll have to support it

SOPA ? Maybe I?m for it after all.

I?m as adamant a supporter of Web free speech as you?ll find. And there?s a lot to dislike about the Stop Online Piracy Act. But when my stories about Web free speech are stolen and posted in their entirety by ?rogue? websites, my head hurts. Stealing content is a funny way to prove your anti-SOPA credentials.

Opponents of controversial anti-piracy legislation called SOPA have been gaining momentum in the past week, and on Wednesday, their show of muscle reached orgasmic proportions.? Perhaps swept up in the excitement of a protest that seems to be working, a long list of websites copied in its entirety a story I wrote about it over the weekend and placed it on their own sites. Here?s one example, viewed early Wednesday afternoon.

Sure, msnbc.com?s name appears there, but the Web site in question gets the clicks and the revenue.? Not fair, I?m sure you?d agree.

For good fun, this ?pirate? version seems to have been run through a translator, and back again. So my, ?Opponents of controversial federal anti-piracy legislation known as SOPA seem to be picking up steam,? has been mangled into, ?Opponents of argumentative sovereign anti-piracy legislation famous as SOPA seem to be picking adult steam.?

It?s the people who steal content and claim they are protected by free speech who are full of adult steam, otherwise known as hot air. I have no patience for Internet users who copy movies, music or software whole-hog, share it with their friends for free and then cry foul at efforts to stop this.

Of course, I haven?t been singled out for story theft.? You can find rogue copies of almost every msnbc.com story ? and any NYTimes.com, and any CNN.com story ? all over the Internet. I?m not talking about ?aggregated? versions, which are gently rewritten copies of someone else?s work, made famous by the Huffington Post. I mean total rip-offs.?

I?m not in favor of SOPA. Blacklisting entire domains is a terrible idea that seems to have been beaten back by reason. Jailing alleged pirates would be Draconian in most cases.? Using the U.S. Justice Department to enforce multinational corporations? intellectual property rights through the criminal court system makes me queasy.? Placing the burden of proof on small websites to show they aren?t violating copyrights is a dangerous turnabout of U.S. law. And perhaps most important, it?s highly doubtful that SOPA would be effective in stopping the kind of content theft I?m writing about here.

For a little more explanation on the reasons SOPA would have done more harm than good, I asked San Diego State University information systems teacher Robert Gillespie, about problems he sees with its enforcement mechanism.

"SOPA ... would leave a great deal of elbow room for interpretation, which is why so many corporations fear the ramifications of its passing," he said.?"It can be implemented with far reaching effects.? For example, if some media site republished a New York Times article without permission, not only can they go after the?site in question, but they can make the search engines (Google, Yahoo, Bing), any add networks, and various other connected business entities (such as ISP, domain, and website host?providers) cease connection with the website in question...This is a bludgeoning tool that is imprecise and clumsy when in the wrong hands.?"

So thank goodness, SOPA in its original form appears dead. But if you don?t think there?s a piracy problem, you?re not paying attention.

How bad is it?? Even U.S. Senators steal content for their websites. (Though I am flattered, Sen. Bernie Sanders. I was proud of that story.) By the way, Sanders? position on SOPA is unknown.

Photographers have been fighting this battle for years, and are doing a relatively good job of using watermarks and other technologies to enforce their rights. In fact, a cottage industry of photography IP lawyers has grown up around the problem, sending bills and other demand letters to photography infringers. (See a discussion of this in ?When is sharing, stealing??) Writers, so far, have gotten nowhere.

You could argue, of course, that imitation isn?t just flattery ? it?s actually good business in the Digital Age. If enough people copy your stories, eventually that comes back to you in a social network-y, ?wisdom of crowds-y, long tail-y kind of way.? Except in rare cases, I don?t buy that.? The math just doesn?t add up.

The real problem is Web culture that suggests everything is free, or should be free. That?s just not a grown-up way of looking at the world.

So tonight, while you?re patting yourself on the back for being a part of a genuine Internet movement that has successfully influenced Congress ? ?an impressive feat, mind you ? ?know that there?s much more work to be done.? Tell a friend they should link to a story instead of copy a story onto a blog.? Because if we don?t find a reasonable way to protect intellectual property rights, you can bet an unreasonable one will rear its ugly head again soon.

Rupert Murdoch turns to Twitter to attack Obama (Reuters)

NEW YORK (Reuters) ? Media baron Rupert Murdoch used his new Twitter account this weekend to attack the Obama administration's opposition to parts of proposed legislation designed to combat Internet piracy.

"So Obama has thrown in his lot with Silicon Valley paymasters who threaten all software creators with piracy, plain thievery," News Corp's chairman and chief executive officer posted on his personal Twitter account Saturday.

Murdoch, whose media empire includes Fox TV, The Wall Street Journal, Fox Studios and the Sun newspaper in Britain, continued with several tweets, attacking Google as the "Piracy leader" for streaming movies free. In later tweets he called Google a "great company."

Google said it did not appreciate Murdoch's comment even after he back-pedaled with a compliment.

"This is just nonsense," Samantha Smith, a Google spokesperson, said in an emailed statement.

"Last year we took down 5 million infringing Web pages from our search results and invested more than $60 million in the fight against bad ads. Like many other tech companies, we believe that there are smart, targeted ways to shut down foreign rogue websites without asking U.S. companies to censor the Internet."

At issue are the concerns White House officials raised on Saturday about elements in the proposed Stop Online Piracy Act (SOPA) pending in Congress. Google and Facebook already have decried them as heavy-handed and Hollywood studios and music labels say the legislation is needed to save U.S. jobs.

In a blog posting, three advisers to President Barack Obama said they believed the act and similar bills could make businesses on the Internet vulnerable to litigation and harm legal activity and free speech.

"Any effort to combat online piracy must guard against the risk of online censorship of lawful activity and must not inhibit innovation by our dynamic businesses large and small," said the officials, including White House cyber-security czar Howard Schmidt.

The House of Representatives' SOPA bill aims to crack down on online sales of pirated American movies, music or other goods by forcing Internet companies to block access to foreign sites offering material that violates U.S. copyright laws.

U.S. advertising networks could also be required to stop online ads and search engines would be barred from directly linking to websites found to be distributing pirated goods.

Those who support stricter piracy rules reacted strongly to Saturday's White House statement, which darkened prospects for legislation already expected to struggle to clear Congress in an election year.

Schmidt and the other advisers said the Obama administration was ready to work with lawmakers on a narrower, more targeted approach to online piracy to ensure that legitimate businesses -- including start-up companies -- would not be harmed.

Murdoch, who opened his Twitter account this year, has used it to colorfully opine on a number of topics. Tweeting last week, Murdoch praised New York City Mayor Michael Bloomberg's latest proposal to overhaul the city's public schools, but referred to New York State Governor Andrew Cuomo as "chicken Cuomo."

He also admitted in a post to his company's mishandling of social network MySpace, which News Corp bought in 2005 for $580 million. Today the site is nearly irrelevant.

"...we screwed up in every way possible..," Murdoch posted last week.

Transformer Prime falls at the hands of XDA dev, rooted

'Twas just days ago that we reported upon developer uproar over the locked bootloader currently taking up residence on the ASUS Transformer Prime -- and now it looks like some of that pain has been alleviated. A tinkerer over at xda-developers has published viperMOD Primer to help you easily root -- or unroot -- your shiny new laptop-tablet hybrid. The software necessary to apply the mod is only available for Windows at the moment, although developer -viperboy- is promising a Linux version in the not-too-distant future. Go ahead, pop the hood on your Prime and take a good look around.

Update: While XDA member -viperboy- created the viperMOD Primer tool, it should be noted that the NachoRoot exploit used by viperMOD was developed by TeamAndIRC.

Entrance poll: 1 in 3 voters prizes electability (AP)

DES MOINES, Iowa ? About a third of GOP caucus-goers say the top quality they seek in a candidate is the ability to defeat President Barack Obama.

That finding comes from early results from an entrance poll of Iowa caucus-goers conducted for The Associated Press and television networks.

About a quarter of early caucus-goers say their top priority is the selection of a true conservative. Just over 1 in 5 say they seek a presidential candidate with strong moral character.

The economy and the federal budget deficit are top issues for caucus attendees, with few citing abortion or health care as their most important concern.

The caucuses are under way in precincts across Iowa and launch the GOP nominating contest.

GOP's Ron Paul Returns to Iowa With Son, Sen. Paul

DES MOINES, Iowa ? Republican presidential candidate Ron Paul is returning to Iowa the day before its leadoff presidential caucuses and hoping to rev up supporters by appearing with his son, U.S. Sen. Rand Paul of Kentucky.

The older Paul, a Texas congressman near the top in recent Iowa polls, stepped off the campaign trail for the New Year's holiday and had returned home.

The father-son team plans a five-city swing by charter jet beginning Monday in Des Moines.

A weekend poll showed Paul narrowly trailing leader Mitt Romney, though Paul's support had ebbed somewhat as his rivals sharply criticized his foreign policy positions.

Turkey's PM pledges full probe into deadly raid (Reuters)

ANKARA (Reuters) ? Turkey's Prime Minister Tayyip Erdogan on Friday promised a full investigation into airstrikes on the Iraqi border that killed 35 villagers whom the military had mistaken for Kurdish militants - an attack that has infuriated minority Kurds in Turkey and Iraq.

The strikes sparked clashes on Friday in Turkey's restive mainly Kurdish southeast and in the autonomous Kurdish northern Iraq region.

In the border village of Gulyazi, thousands of mourners attended funerals after digging deep graves along a steep cliff. The bodies, most of them young villagers who were smuggling cigarettes and diesel, were ferried on tractors or wrapped in carpets lashed to donkeys making their way along snowed tracks.

Breaking his silence over an attack Turkey's largest pro-Kurdish party has labeled a crime against humanity, Erdogan said video recordings of the air raid would be examined and forensic experts would be dispatched to the area.

"All necessary steps will be taken," Erdogan told reporters, calling the incident, one of the largest single-day civilian deaths in a decades-long conflict, unfortunate and saddening.

But Erdogan also defended the Turkish military, which has been fighting Kurdistan Workers' Party (PKK) armed militants since the group took up arms against the Turkish state in 1984.

The military had said its warplanes launched air strikes after drones spotted what looked like suspected PKK militants.

"Unfortunately, it's not possible to determine who's who from these images taken by drones. These images showed a group of 40 men near the border," Erdogan said, adding the PKK has used smugglers and mules to carry out attacks in the past.

"Our F16 jets have bombed the area as a result."

The attack undermined efforts by Erdogan to engage Kurds in talks to write a new constitution expected to address long-held Kurdish grievances. Kurds, a minority that inhabits Turkey, Iraq, Syria and Iran, have become increasingly assertive.

Some 500 protesters gathered on Friday in Arbil, the capital of Iraq's Kurdish region, to protest the killings. Some protesters threw stones and clashed briefly with Kurdish security forces, but there were no reports of casualties.

"The crime ... is a real genocide, a war crime and a crime against humanity, and breaches international laws," Kurdish activist Ali Mahmoud said. "We demand that Turkey be judged in the international courts."

The protesters carried PKK flags and pictures of its leader, Abdullah Ocalan, and shouted, "fight, fight for freedom" and "Erdogan is a terrorist."

"The Kurdish people must protest and condemn what happened," activist Lalo Rangder said. "Erdogan is a terrorist and has two faces in the sense that he asks the international community to protect Syrians and at the same time is killing Kurdish people with forbidden weapons."

Clashes also broke out across cities in Turkey's Kurdish areas and in its largest city Istanbul.

UN PROBE

Turkish rights groups called for a U.N.-sponsored probe.

"Turkish and international non-governmental organizations should investigate the incident and the U.N. Human Rights Committee should send a committee right away," human rights groups IHD and Mazlumder said in a preliminary report into Wednesday's airstrike.

IHD and Mazlumder said most of those killed near the border village of Uludere were between the ages of 12 and 18. Turkish media have reported that 28 out of the 35 dead belonged to the same extended family and carried the same surname.

In their report, IHD and Mazlumder quoted 19-year-old Haci Encu, who survived the attack and was in hospital, as saying the smugglers were a group of about 40-50 people with mules and were attacked as they were crossing the border to Iraq.

As the group saw the planes overhead, "we started running towards Iraq, and bombs started to fall on those who were left behind on the rocky area. We were six people in my group, and three of us survived. We had civilian clothes and nobody was armed," Encu said.

"We have been doing this for a long time. Two people from the group were married, the rest were high school and secondary school students. Nobody has contacted me for testimony yet, and I haven't seen a single soldier since the incident."

The deaths threatens to ignite more violence from the PKK, which is regarded as a terrorist organization by Turkey, the European Union and the United States. The group has been fighting for an ethnic Kurdish homeland in a conflict that has claimed the lives of 40,000 people.

A PKK commander called on Kurds to rise up to what he called an organized and planned massacre.

"We call on all the people of Kurdistan and especially those of Hakkari and Sirnak to show their reaction against this massacre and to hold the perpetrators of this massacre accountable through their uprising," Bahoz Erdal said in a statement.

With most Turks favoring a hardline military response against the PKK, the incident is unlikely to hurt the popularity of Erdogan, who won a third term in office in a June vote.

NEW ORLEANS ? The actress who played Elly May Clampett on the "The Beverly Hillbillies," toymaker Mattel Inc. and CBS Consumer Products Inc. have settled a lawsuit that claimed the companies didn't get the actress' approval to use her name and likeness for a Barbie doll.

Douglas played the critter-loving tomboy for nine seasons of the CBS television comedy about a backwoods family that strikes oil and moves to Beverly Hills.

A one-sentence order Tuesday in U.S. District Court in Baton Rouge said only that a settlement had been reached. Details of court settlements typically are kept private. However, Douglas' lawsuit sought compensation of at least $75,000.

In earlier filings, CBS and Mattel said they didn't need her approval because the network held exclusive rights to the character.
